Entry requirements

Admission to the course requires, apart from general entry requirements, that the specific entry requirements that apply for admission to the Bachelor's Programme in Commercial and Business Law, or the Bachelor's Programme in Commercial and Business Law with Focus on Europe, are satisfied. In addition, the student should have completed the courses Commercial and Business Law and Theories and Methods of Law.

Intended learning outcomes

On completion of the course, the student should be able to
- account for the regulatory system of the Swedish state and administrative law and European law, at a basic level,
- identify and solve legal issues within both public law and European law,
- use information technology as an aid to retrieve legal material,
- explain more complicated legal arguments within said legal fields,
- reflect on the issues of said legal fields,
- evaluate the reasonableness and consequence of chosen solutions,
- critically examine and analyse legal source material,
- account for how the European law interacts with and influences Swedish national law.

Course content

This course covers both Swedish constitutional law and Swedish administration and local government law, as well as European law.

The course begins with an overview of the development of the Swedish constitution starting from 1809, which includes an orientation in the Swedish party system and interest groups. After that, the studies are focused on constitutional law on the composition and activities of the highest state authorities, basic freedoms and rights, the division of functions between the state authorities, constitutional control, freedom of the press and freedom of speech in other media and public access to documents and confidentiality.

The municipal and administrative law studies focus on the municipal and government funded organisation's structures and functions, as well as the regulatory framework of its fundamental features. This part includes studies of the bases of the administrative process law.

In the European law, the emphasis is on the regulatory system concerning the common market regarding free mobility for goods, services, capital and manpower, but also addresses, for example, the customs union, Union membership and the single currency. The legislative process at the EU level is covered with a focus on the authorities of the legislative bodies. Further, the interplay between European law and Swedish national law is studied through, for example, the precedence, direct effect and preliminary rulings of the European law. A general presentation of the joint foreign and the security policy is given, as well as the police and criminal law cooperation in the EU.

Apart from through the material European law, the course also covers the European law's legal sources in a practical exercise by retrieving material such as ordinances, directives, legal cases and other journals via modern information technology.

The course also includes an introduction in French and German constitutional law with teaching in the French and German language, respectively. This part only includes students at the Bachelor's Programme in Commercial and Business Law with Focus on Europe. Students at the Bachelor's Programme in Commercial and Business Law receive an introduction to economic law with a focus on public law issues.

Teaching and working methods

The teaching takes the form of lectures, seminars and practical exercises. Participation in seminars and library exercises are compulsory. Further, optional and/or compulsory written assignments, to be solved in groups and/or individually, may occur.

Participation in the French and German legal modules is compulsory for students in the Bachelor's Programme in Commercial and Business Law with Focus on Europe as well as lectures in law and economics for students in the Bachelor's programme in Commercial and Business Law.

Examination

The course is examined through written independent examination and through active participation in seminars and library exercises. If compulsory written assignments occur, these parts are also examining.

Students failing an exam covering either the entire course or part of the course twice are entitled to have a new examiner appointed for the reexamination.

Students who have passed an examination may not retake it in order to improve their grades.

Planning and implementation of a course must take its starting point in the wording of the syllabus. The course evaluation included in each course must therefore take up the question how well the course agrees with the syllabus. 

The course is carried out in such a way that both men´s and women´s experience and knowledge is made visible and developed.
